ONLINE STORE CONTRACTING CONDITIONS

MODIFICATION OF THESE CONDITIONS AND DURATION

MUSICANDO 10 SL may modify the conditions set forth herein at any time, and these will be duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will remain in force until they are modified by others that are duly published. The last modification of the conditions is from 11/18/2020.

SECURITY

The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorized access to data. To achieve these purposes, the user/client accepts that the provider obtains data for the purposes of the corresponding authentication of the access controls.

Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol, encrypting the data sent using the RSA encryption system, so that no one can appropriate it because they do not have the necessary key. You can check that your browser is secure if the padlock symbol appears and you can also see that the URL changes slightly: it no longer begins with http but with https.

SHIPPING COSTS

Shipping and/or handling costs are not included in the price and will be shown to you before finalizing your purchase, depending on the shipping address of each order. Below, we detail the shipping costs in the following table:

  • Spain: €2.95 (mainland), €4.95 (Balearic Islands)
  • For shipments to the Canary Islands, please contact us first.
  • Europe: €8.95. Rest of the World: €9.95

Delivery time in Spain: Between 1 and 2 days.

PLACING THE ORDER

To place an order, you must log in to https://www.nandoagueros.com and register as a user, filling out the electronic form that appears on the online store's website at any given time and following the instructions indicated therein. After registering, and to proceed with the purchase of products, you must add the product you wish to purchase to your basket, following the instructions on the screen, filling out the order form provided for this purpose and validating it.

The prices presented on the website are valid only and exclusively for online orders placed at https://www.nandoagueros.com. All prices published on our website include VAT.

Validation of the order by the customer expressly implies knowledge and acceptance of these general contracting conditions as part of the conclusion of the contract.

Once the purchase has been made and as soon as possible, always within 24 hours of making the purchase, the MUSICANDO 10 SL Customer Service will send you a receipt of the purchase by email.

If you do not agree with the data entered in said confirmation, you may request that it be modified or the contract be cancelled.

LANGUAGE OF FORMALIZATION OF THE CONTRACT

The language or languages in which the contract may be formalized on this website is Spanish.

PRODUCT AVAILABILITY

The selection of products offered on https://www.nandoagueros.com is valid as long as the products are visible on the website. As this is an e-commerce site, stock is updated online, so it may happen that the stock runs out during the purchasing process.

If this happens, we will inform you immediately to offer you an alternative or to refund the amount paid for the product.

HOW TO MAKE A CLAIM

To make any claim in relation to the obligations established in Article 110 of Law 3/2014, you must contact us.

LACK OF EXECUTION OF THE CONTRACT

In the event of non-execution of the contract by the entity due to the unavailability of the purchased product or for any other reason, the client will be informed of this lack of availability and/or the reason justifying it and will recover without undue delay the sums paid under the contract.  In the event of unjustified delay on the part of MUSICANDO 10 SL with respect to the return of the sums paid, the client may claim payment of double the amount owed, without prejudice to his right to be compensated for damages suffered in excess of said amount.

SHIPPING METHOD AND TIME

Products are sent to the shipping address you indicated in your order. If you order several items with different availability, the delivery time will take into account the longest expected delivery. In exceptional cases, MUSICANDO 10 SL reserves the right to split the order, sending the available items and leaving the unavailable items pending a second delivery.

To carry out the transport and delivery of shipments, we have chosen a renowned courier company.

The established shipping time will depend on the requested order. It will be approximately five business days from receipt of payment, considering business days as business days from Monday to Friday.

In the event that the customer detects any problem upon delivery of their order (damaged packaging, missing or damaged products), they must indicate this in writing on the carrier's delivery note and contact us within 14 days of receipt. No return of damaged item will be accepted, as well as no claim for missing item, if this has not been communicated within the established period, sending us photos and a description of the problem.

All of this without prejudice to the right to a guarantee for products that do not comply with the contract that is available to all consumers, in accordance with current regulations.”

PAY

MUSICANDO 10 SL accepts payment by credit card, you can use Visa and MasterCard. If you pay with a VISA or Maestro card, the charge on your card will be made in a deferred manner, that is, at the time of shipment. In this way, only the items shipped and at the time of shipment will be charged. In the event that the POS informs that the card has been refused, the order will be automatically cancelled, informing the customer online of the cancellation. For payments made with cards issued outside Spain, it is necessary that the issuing bank is covered by the Secure Electronic Commerce Security Protocol (CES). Payments with cards that do not meet this requirement will not be accepted. As an alternative, we offer payment by transfer. MUSICANDO 10 SL reserves the right to reject any transaction made with a credit card. In this case, we will proceed to refund the cash to the original card. In these cases and if the customer is interested in progressing with the purchase of the items, we will request a bank transfer.

RIGHT OF WITHDRAWAL

If you are not satisfied, you can return your purchases made at https://www.nandoagueros.com at our office located at Bº La iglesia 32 nºE - 39314 Viveda, by completing the withdrawal document that you can download here.

The maximum period to request a refund is stipulated in the following periods, from receipt of the order:

-14 calendar days for all products in our online store.

The refund will be made using the same payment method as the purchase. This right is additional to the warranty right recognized in Royal Decree-Law 1/2007 of 16 November on the protection of consumers and users.

The circumstances that may result in a refund are as follows:

a) If you are not satisfied with the product you have ordered: You can return it via courier to MUSICANDO 10 SL. We will refund the amount of the product but not the costs of returning the product.

b) If you wish to exchange it for another item, the return costs will not be covered by MUSICANDO 10 SL

c) Product that, by mistake, does not correspond to the order: MUSICANDO 10 SL will bear the costs of collecting the wrong product and delivering the one corresponding to the order placed.

d) The products must be packaged and unsealed. The packaging must be in perfect condition and retain all its original accessories and instructions in order to be returned.

Returns of products that have not been purchased from the entity will not be accepted in physical stores or in the online store of MUSICANDO 10 SL.

In all cases, the products must be in perfect condition, in their original packaging and with the manuals, accessories or promotional gifts, if applicable, included.

In accordance with article 103 of Law 3/2014 on the Protection of Consumers and Users, the right of withdrawal is excepted for those products that are clearly personalized or that have been made according to the client's specifications.

ORDER CANCELLATION

In the event that an order is cancelled before it has been shipped, the customer will not incur any costs. In the event that an order is cancelled after the goods have been shipped, the customer will be responsible for the shipping costs as well as the costs of returning the order.

PRODUCT WARRANTY

The warranty period is 2 years from the delivery of the product, although this does not include defects caused by negligence, knocks, incorrect use or improper handling, or materials that are worn out by use. Unless proven otherwise, it will be presumed that any lack of conformity that becomes apparent within 6 months after delivery of the product, whether new or second-hand, already existed when the item was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity. MUSICANDO 10 SL reserves the right to request an official technical service of the brand to verify the origin of the problem. In the event of a defect caused by misuse, the repair will be billable. In those cases that justify the application of the warranty, the option will be to repair, replace the item, discount or return, under the legally established terms.

REFUND OF AMOUNTS PAID

The refund will be made through the payment method you used for the purchase.

MUSICANDO 10 SL will not refund the amount or resend any merchandise until the receipt and condition of the packaging and accessories of the item being returned or exchanged have been verified in our warehouses. The price to be refunded is the one originally stated in the order, except for shipping costs. Once the correct condition of the returned product has been verified, MUSICANDO 10 SL will refund the amount within a maximum period of 15 days.

APPLICABLE LEGISLATION AND JURISDICTION

The relationship between MUSICANDO 10 SL and the USER will be governed by current Spanish regulations and any dispute will be submitted to the Courts and Tribunals of the corresponding city.

ONLINE DISPUTE RESOLUTION PLATFORM

The entity is attached to the online dispute resolution in consumer matters in accordance with Art. 14.1 of Regulation (EU) 524/2013: The European Commission provides an online dispute resolution platform that is available at the following link:

Consumers will be able to submit their complaints through the online dispute resolution platform.
